ARTICLE 1 – DEFINITIONS
In these General Terms and Conditions, the following terms shall have the meanings assigned to them:
Cooling-off period: The period during which the Consumer may exercise the right of withdrawal.
Consumer: A natural person not acting in the course of a trade, business, or profession who enters into a Distance Agreement with the Entrepreneur.
Duration agreement: A Distance Agreement relating to a series of products and/or services for which the supply or purchase obligation is spread over time.
Durable medium: Any tool that enables the Consumer or Entrepreneur to store information personally addressed to them in a way that allows future access and unchanged reproduction of the stored information.
Right of withdrawal: The Consumer’s right to cancel a Distance Agreement within the Cooling-off period.
Entrepreneur: The natural or legal person offering products and/or services to Consumers remotely.
Distance Agreement: An agreement concluded within a system organised by the Entrepreneur for remote sales of products and/or services, where exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.
Means of distance communication: A method which allows an agreement to be made without the Consumer and Entrepreneur being physically present at the same time.
General Terms and Conditions: These General Terms and Conditions of the Entrepreneur.

ARTICLE 3 – APPLICABILITY
These General Terms and Conditions apply to every offer from the Entrepreneur and to all Distance Agreements and orders concluded between the Entrepreneur and the Consumer.
Before a Distance Agreement is concluded, the text of these Conditions will be made available to the Consumer. If this is not reasonably possible, the Entrepreneur will indicate how the Conditions may be viewed and that they will be sent to the Consumer free of charge upon request.
If the Distance Agreement is concluded electronically, these Conditions may be supplied in such a way that the Consumer can easily store them on a durable medium.
Should specific product or service conditions apply in addition to these General Terms and Conditions, both sets of terms shall apply, and in the event of contradiction, the Consumer may rely on the provision most favourable to them.
If any clause of these Conditions is found to be invalid, the remaining provisions shall continue to apply. Any situation not covered will be interpreted “in the spirit” of these Conditions.
ARTICLE 4 – THE OFFER
If an offer has a limited validity period or is subject to conditions, this will be clearly stated.
All offers are non-binding. The Entrepreneur reserves the right to amend or withdraw an offer.
Descriptions of products and/or services are provided with sufficient detail to enable a reasonable understanding. Photographs and images are intended to represent the products truthfully, though slight variations in colour or appearance may occur.
Obvious mistakes or clerical errors in the offer do not bind the Entrepreneur.
Each offer shall include clear information regarding:
The price (exclusive of import VAT and customs duties, which are payable by the Customer);
Any shipping costs;
Payment, delivery, and execution methods;
The applicability of the right of withdrawal;
The period during which the offer is valid; and

the steps necessary to conclude the agreement.
ARTICLE 5 – THE AGREEMENT
The agreement is established once the Consumer accepts the offer and meets its stated conditions.
When an offer is accepted electronically, the Entrepreneur shall promptly confirm receipt. Until this confirmation is received, the Consumer may cancel the order.
The Entrepreneur shall implement appropriate technical and organisational measures to protect electronic data transmission and ensure secure payment processing.
The Entrepreneur reserves the right to verify a Consumer’s payment capability and, based on reasonable grounds, to refuse or impose special terms on an order.
Upon delivery, the Entrepreneur will provide the Consumer with:

contact details for submitting complaints;

information on the right of withdrawal and any applicable exclusions;

warranty and after-sales information; and
-
a copy of these General Terms and Conditions.
ARTICLE 6 – RIGHT OF WITHDRAWAL
For Products:
The Consumer may cancel a purchase within 30 days of receiving the goods, without giving a reason. The Entrepreneur may request, but not require, an explanation.
The 30-day period begins:
-
the day after the Consumer or an authorised third party (other than the carrier) receives the goods;
-
when multiple items are ordered, on the day the final item is received;
-
when a product is delivered in parts, on the day the last part is received.
For Services and Digital Content:
The Consumer may withdraw within 30 days from the date of agreement, provided the service or content has not yet been fully delivered.
If the Entrepreneur has not provided the required withdrawal information, the withdrawal period shall extend up to 12 months. Once the information is supplied, the period will expire 30 days thereafter.
ARTICLE 7 – CONSUMER OBLIGATIONS DURING THE COOLING-OFF PERIOD
During the cooling-off period, the Consumer must handle the product and packaging with due care. Products should only be used as necessary to determine their nature and function, as would be permitted in a retail shop.
The Consumer is liable for any reduction in value caused by use beyond this limit unless the Entrepreneur failed to provide the required withdrawal information.
ARTICLE 8 – EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The Entrepreneur may exclude withdrawal rights only if clearly stated prior to purchase.
Exclusions apply to products:
-
made to the Consumer’s specifications or clearly personalised;
-
unsuitable for return for hygiene reasons once unsealed;
-
likely to deteriorate or expire quickly;
-
such as newspapers, magazines, audio/video recordings, or software where seals are broken.
Exclusions may also apply to services related to accommodation, transport, catering, or leisure when a specific date is agreed, or where performance has begun with the Consumer’s consent before expiry of the withdrawal period.
ARTICLE 9 – PRICES
Prices shall not increase during the validity period stated in the offer, except as a result of statutory VAT changes.
The Entrepreneur does not charge VAT on exports; import VAT and customs duties are the responsibility of the Consumer.
All prices are subject to printing or typographical errors, for which no liability is accepted.
ARTICLE 10 – CONFORMITY AND WARRANTY
The Entrepreneur guarantees that the products conform to the agreement, the stated specifications, and reasonable standards of quality and usability.
Defective or incorrectly delivered products must be reported within 30 days of delivery and returned in original packaging and unused condition.
The warranty does not cover defects resulting from improper or unauthorised handling, modification, or failure to follow usage instructions.
ARTICLE 11 – DELIVERY AND EXECUTION
Orders are executed with the greatest possible care.
Delivery shall occur at the address provided by the Consumer. Accepted orders will be dispatched promptly and no later than 30 days, unless otherwise agreed.
If a delay occurs, the Consumer will be informed within 14 days and may cancel the order without cost. The full amount will then be refunded within 14 days.
The Entrepreneur bears the risk of loss or damage until delivery to the Consumer.
ARTICLE 12 – DURATION AGREEMENTS: TERMINATION AND RENEWAL
Consumers may terminate ongoing or fixed-term agreements for regular delivery of goods or services with a notice period of no more than one month.
Contracts cannot be tacitly extended beyond their original term, except for short trial subscriptions not exceeding three months.
Agreements exceeding one year may be terminated at any time after the first year with one month’s notice.
ARTICLE 13 – PAYMENT
Unless otherwise agreed, payment must be made within 7 working days from the start of the cooling-off period.
The Consumer must promptly report any inaccuracies in payment data.
In case of non-payment, reasonable recovery costs may be charged, provided these have been communicated in advance.
ARTICLE 14 – COMPLAINTS PROCEDURE
Complaints must be submitted in writing within 7 days after discovering a defect.
The Entrepreneur shall respond within 14 days of receipt. If more time is needed, an acknowledgement and estimated response date will be provided.
If a complaint is justified, the Entrepreneur will, at its discretion, replace or repair the goods free of charge.
ARTICLE 15 – DISPUTES
These Terms and Conditions and all related agreements are governed exclusively by the UK law, regardless of the Consumer’s place of residence.
ARTICLE 16 – SMS MARKETING
By consenting to receive SMS marketing from Noir & Lumière during checkout or registration, you agree to receive recurring text messages about your orders, abandoned cart reminders, promotional offers, and service notifications. Message frequency may vary. Consent is not a condition of purchase.
To unsubscribe, reply STOP to any message or use the link provided in our texts. Alternative unsubscribe methods will not be recognised. Standard message and data rates may apply.

We may update our sending numbers or short codes; if so, we will inform you accordingly. Messages sent to outdated numbers may not be received, and we are not liable for such cases.
